Your right to dispute inaccurate listings
You may dispute inaccurate and contestable information in your credit report by contacting the
relevant credit provider, the relevant industry Ombudsman, or The Office of the Australian Information
Commissioner directly.
A credit reporting agency may also investigate and modify or remove inaccurate, obsolete, or
incomplete information. If the credit reporting agency does not resolve the dispute to your satisfaction,
you may send a brief statement to the credit reporting agency, to be kept in your file, explaining why
you think the record is inaccurate, obsolete, or incomplete information. The credit reporting agency
may include a summary of your statement about disputed information with any report it issues about
you.
Importantly, neither you nor any credit restoration organization can have accurate, current, and
verifiable information removed from your credit report.
Credit reporting agencies will remove accurate information on your report after
5 years for defaults,
clear-outs - 7 years,
serious credit infringement - 7 years,
judgments and court writs - 5 years, credit
enquiries - 5 years,
previous directorships - 10 years.
Additionally, bankruptcy information can be reported for a minimum of 5 years,
Repayment history (last 24 months worth of payments made on both Open and Closed credit accounts).
Your right to obtain a free credit report
You have the right to obtain a credit report from a credit reporting agency. Some agencies may
request a fee prior to providing you with your credit report. Please note that the information on each
credit file may vary. You are able to obtain a copy of your credit report for free from a credit reporting
agency if:
- You have applied for, and been refused credit, within the past 90 days
- Your request relates to a decision by a credit reporting bureau or a credit provider to correct
information in your credit report, and
- Once a year (not counting the above circumstances).

Please note that in the instance Fix My Credit File Australia accesses your consumer credit report,
we will be listed as an ‘access seeker’ on your report. This is not classified as a credit inquiry.
By nominating us as an Access Seeker, we will be using your access rights to consumer credit
information which means you may be charged in the future for information that may have been
available for free from credit reporting bodies.
Obligations of credit providers
Credit Providers are required to follow reasonable procedures to ensure that the information they
report to a credit reporting agency is accurate and in accordance with the relevant laws and
regulations. However, mistakes may occur.
If you dispute the information contained on your credit report, then you may contact the relevant credit
provider or credit reporting agency with the details of your dispute. If your dispute is unable to be
resolved by the credit provider or the credit reporting agency, then it may be referred to an impartial
external dispute resolution service, which is free for consumers.
Credit Reporting Bodies
Fix My Credit File Australia may obtain credit reports from Equifax, Illion, and Experian (Credit Reporting
Bodies). In the event that Fix My Credit File Australia obtains your report from one of these providers:
(a) The Credit Reporting Bodies will collect your personal information provided by us to them in
connection with our request for access seeker services;
(b) The Credit Reporting Bodies and their related companies may use and disclose such personal
information to manage the provision of credit reporting information and the access seeker services,
and to undertake data management for quality-related purposes;
(c) The Credit Reporting Bodies' Privacy Policies contain information about how they handle personal
information (other than credit reporting information), including how an individual may access his or her
personal information held with them and their related companies and seek the correction of that
information, and how an individual may complain about a breach of the Australian Privacy Principles
and how they and their related companies will deal with such a complaint. The Privacy Policies are

Financial hardship
If you are in financial hardship, you can contact your lender or credit provider and apply for a hardship
variation.
You may also be able to seek free legal and financial advice from many community organizations,

No guarantee
Even if one or more listings are amended on your credit report or your credit report is updated, there is
no guarantee that you will be successful in obtaining credit, or that your credit score will improve.
By law, a credit provider must not enter into a contract with you that is unsuitable, such as a loan you
can't repay without suffering hardship, or a contract that doesn't meet your requirements and
objectives.
Credit providers may base their decision to approve finance on their own lending criteria, which may
take into account a number of factors such as your ability to afford repayments, the security of your
financial position, and the information listed on your credit report.

Cooling-off Period
If you enter into an agreement with Fix My Credit File Australia, then you will be entitled to a cooling-off
period of 3 business days, which starts the day after the agreement, unless you have requested that
Fix My Credit File Australia deal with your matters on a priority basis.
Exit Fees
If you enter into an agreement with Fix My Credit File Australia, a cancellation fee may apply if you cancel
outside of your cooling-off period. The cancellation fee includes any administration fees charged and
any completed service fees. Any applicable cancellation fees will be disclosed to you prior to entering
any services.
